ORDER:

  1. Petitioners challenged the Government decision to upgrade the Language Pandits as School Assistant (Languages) by absorbing the existing Language Pandits as School Assistants (Languages) as per their seniority and eligibility.
  2. The contention of the learned counsel for the petitioners is, as per the Rules notified in G.O.MS.No.12 School Education (SER.II) Department, dated 23-01-2009, posts notified in Class-II of the services are eligible for promotion to the post including in Class-I of the service. Language Pandits, Physical Education Teacher and several other posts are mentioned in Class-II and are eligible for promotion to the post of School Assistant. By virtue of the Government Orders, while upgrading the posts of Language Pandits to that of School Assistants, the Government straightaway accorded absorption of all existing Language Pandits, ignoring the statutory provisions and the seniority under  Class-II category.
  3. Prima facie, there is merit in the contention. Upgrading posts is one aspect and upgradation of officers working in the existing posts to upgraded posts is a different aspect and merely because, persons who were working as Language Pandits cannot automatically be upgraded as School Assistants ignoring seniors working in Class-II category. Thus, balance of convenience is in favour of the petitioners.
  4. The respondents are directed not to fill up the posts of School Assistants (Languages) till recruitment rules are amended.
