ORDER



  1. Through the Constitution 32nd amendment Act, 1973, the Article  371-D was inserted with respect to the State of Andhra Pradesh to provide equitable opportunities and facilities for the people belonging to different parts of the State, in the matter of public employment and education. Accordingly, the Andhra Pradesh Public Employment (Organization of Local cadres and Regulation of Direct Recruitment) Order, 1975, also commonly known as “Presidential Order” was republished vide G.O.Ms.No.674 G.A.(SPF)Department, dated: 20.10.1975.
  2. The new State of Telangana has been formed vide reference 2nd read above with the territories specified in Section 3 of the A.P. Re-organisation Act, 2014. Subsequently, vide reference 3rd read above, the Ten (10)  Districts in Telangana State have been re-organised and Thirty One (31) new Districts have been formed. In view of the formation of the Telangana State and subsequent re-organisation of the Districts, Revenue Divisions & Mandals, necessity has arisen to issue either amendments to the existing Presidential Order or preparation of new Presidential Order suitable for the requirements of the new State of Telangana.
  3. This issue of review of existing Presidential Order, 1975 has been discussed at various levels on several occasions with the concerned Officials as well as the representatives of the employee unions. There has been an overwhelming consensus in all the above meetings that in the context of the new Telangana State, there is a felt need for two tier system consisting of District cadre, with 31 new Districts as District units, and State cadre for the different categories of posts pertaining to the two distinct levels of administration, namely, District and State levels. This system is proposed in place of the existing three tier system of District cadre, Zonal / Multi Zonal cadre and State cadre. Accordingly, the existing District, Zonal and State cadre posts would need to be re-organized from the existing three tier  system to the proposed two tier system keeping in view the administrative factors as well as public interest so as to define the various provisions like local status of the candidates in the new Presidential Order.
  4. It has also emerged during the discussions that the provisions of the Andhra Pradesh Public Employment (Organisation of Local Cadres & regulation of Direct Recruitment) Order, 1975, and subsequent amendments
  5. / clarifications etc., shall continue to be applicable to the employees working as on the date of enforcing of the proposed Presidential Order. It would, therefore, be consequently necessary to propose in the new Presidential Order the transitional provisions of the existing Presidential Order so as to protect the interests of the existing employees till they are in service.
  6. Government after careful examination of the matter have decided in principle to formulate a new Presidential Order with two tier system in place of the existing three tier system and for this purpose also decided to authorize the Chief Secretary to the Government of Telangana to work out the detailed modalities for implementation of the above decision by holding widespread consultation with all the stakeholders.
  7. The Chief Secretary to Government is therefore requested to conduct the consultation process and furnish report with detailed recommendations to Government at the earliest, so as to enable the Government to formulate the new Presidential Order and submit to the Government of India for their approval.
